Archie Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Archie platform and related services (the “Service”) operated by Archie Works, Inc., a Delaware corporation (“Archie,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to these Terms.
The Archie Promise
- Your memories belong to you.
- You control who can access your memories.
- Your private life stays private.
Archie exists to help you preserve and celebrate the extraordinary life you are living.
1. About Archie
Archie is a private memory platform that allows users to store, organize, and share personal memories including photos, videos, documents, milestones, and written memories.
Features may include:
- photo tagging
- face recognition
- AI-generated summaries
- memory timeline generation
- recap videos
- search and organization tools
- family collaboration tools
- family tree features
Some features may rely on automated or artificial intelligence systems.
2. Eligibility
You must be 18 years or older to create an account. Children may not create accounts.
If you upload content involving children or other individuals, you represent that you have obtained all necessary permissions or legal authority to upload and share such content.
You represent and warrant that you have the legal authority to share any content involving minors or third parties.
3. Accounts
You are responsible for:
- maintaining the confidentiality of your account credentials
- all activity occurring under your account
- ensuring that access to your account and sharing links are controlled appropriately

4. Privacy
Your use of the Service is governed by the Archie Privacy Policy.
Archie does not sell user memories, photos, or videos.
Archie may use anonymized, aggregated, or de-identified data to improve the Service, develop features, and enhance performance.
Archie team members may access your photos, captions, and tags as needed to provide support, troubleshoot issues, or fulfill keepsake book orders. Access is limited to authorized team members.
5. Ownership of Content
You retain ownership of all content you upload (“User Content”).
User Content may include:
- photos
- videos
- written memories
- documents
- captions
- family history data
Archie does not claim ownership of your memories.
6. License to Archie
To operate, improve, and provide the Service, you grant Archie a non-exclusive, worldwide, royalty-free, fully paid, transferable, and sublicensable license to:
- host
- store
- reproduce
- process
- adapt
- modify (for technical purposes)
- create derivative works (solely to enable functionality)
- display
- transmit
- distribute
This license is granted solely for the purpose of operating, improving, and providing the Service and its features, including but not limited to:
- photo tagging
- face recognition
- timeline generation
- recap videos
- search and organization
- AI-assisted features
Archie does not sell or commercially exploit your personal memories.
7. AI Features
Archie may use automated technologies and artificial intelligence to help organize memories. AI-generated outputs may:
- contain errors
- misidentify individuals
- produce incomplete summaries
Users should review AI-generated outputs before relying on them. Archie does not guarantee the accuracy of AI-generated outputs.
AI features may evolve over time and may rely on third-party models or infrastructure. You acknowledge that:
- outputs may be inaccurate or incomplete
- outputs should not be relied upon as factual records
- Archie is not responsible for decisions made based on AI-generated content
8. Sharing Controls
Account owners control sharing. Content may be shared through:
- invited friends and family members
- private share links
- password-protected links
Recipients of shared links may view but not edit content unless permissions are granted.
Once you share content with others, Archie cannot control how recipients may use it, including screenshots, downloads, forwarding, or redistribution outside the Service.
9. Export & Backup
Users may export their content at any time using available tools. Users are responsible for maintaining independent backups. Archie does not guarantee permanent storage of user content.
10. Deletion & Retention
When content is deleted or accounts are closed:
- content is removed from active systems
- backup copies may persist for up to 30 days
- content is then permanently deleted during routine maintenance
11. Subscriptions
Archie may offer:
- annual subscriptions
- premium storage
- concierge services
- printed memory books
- gift subscriptions
Subscriptions automatically renew unless canceled prior to renewal. Fees are non-refundable except where required by law. Archie reserves the right to change pricing with reasonable notice.
12. Affiliate Recommendations
Archie may recommend third-party products. Archie may receive compensation through affiliate partnerships. Archie does not share private user content with affiliate partners.
13. Acceptable Use
You agree not to:
- upload illegal content
- upload content without proper rights or permissions
- scrape or automate access to the Service
- bypass security protections
- harvest user information
- distribute malware
- impersonate others
- send spam through the Service
You also agree not to:
- use the Service to build a competing product
- reverse engineer or attempt to extract source code
- use automated systems (bots, scrapers) without permission
- interfere with platform integrity or performance
Archie reserves the right to investigate violations and take appropriate action, including:
- removing content
- suspending accounts
- terminating access
- reporting to law enforcement
Archie may suspend or terminate accounts for violations.
14. Intellectual Property
All platform software, design elements, trademarks, and branding remain the property of Archie Works, Inc. You may not reproduce or reverse engineer the Service without permission.
Except for your User Content, all rights, title, and interest in the Service remain exclusively with Archie.
15. Third-Party Services
Archie may rely on third-party providers including:
- hosting providers
- payment processors
- analytics services
- printing partners
Archie is not responsible for third-party policies or services.
16. Termination
Archie may suspend or terminate accounts if:
- these Terms are violated
- the Service is misused
- continued access poses risk to users or the platform
Archie may remove content at its discretion.
Upon termination, your right to access the Service ceases immediately. Certain provisions will survive termination, including:
- ownership
- licenses
- disclaimers
- limitation of liability
- dispute resolution
17. DMCA Copyright Policy
Archie respects intellectual property rights. To submit a DMCA notice include:
- signature
- identification of copyrighted work
- location of infringing content
- contact information
- statement of good faith belief
- statement under penalty of perjury

Archie may remove allegedly infringing material and terminate repeat infringers.
18. Security
Archie uses reasonable safeguards to protect user data. However, no system can guarantee complete security. Users acknowledge inherent risks of online services.
19. Disclaimer of Warranties
The Service is provided “as is” and “as available.” Archie disclaims all warranties, express or implied, including:
- merchantability
- fitness for a particular purpose
- non-infringement
- accuracy or reliability
20. Limitation of Liability
To the maximum extent permitted by law, Archie shall not be liable for:
- indirect, incidental, consequential, or punitive damages
- loss of data
- loss of profits
Total liability is limited to the greater of $100 or amounts paid in the prior 12 months.
21. Indemnification
Users agree to indemnify Archie for claims arising from:
- uploaded content
- misuse of the Service
- violations of these Terms
22. Arbitration
Informal Resolution First
Before initiating arbitration or legal proceedings, you and Archie agree to attempt to resolve any dispute, claim, or controversy informally by contacting us at stef@yourarchie.com. Both parties agree to engage in good faith efforts to resolve the dispute for at least 30 days before initiating arbitration.
Agreement to Arbitrate
Except for claims eligible for small claims court, any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration, rather than in court. This arbitration agreement is governed by the Federal Arbitration Act (FAA).
Arbitration Process
Arbitration will be administered by either:
- JAMS, under its Streamlined or Comprehensive Rules, or
- AAA, under its Consumer Arbitration Rules
(as determined by Archie).
Individual Basis Only
You agree that disputes will be brought only on an individual basis, and not as part of any class, collective, or representative action.
Batch Arbitration
To increase efficiency and reduce costs, if multiple similar claims are filed against Archie by the same or coordinated parties, Archie may require that such claims be grouped and resolved in coordinated batches, with procedures determined by the arbitration provider.
Small Claims Option
Either party may bring eligible claims in small claims court.
Location
Unless otherwise required by law, arbitration will take place in Delaware, or may be conducted remotely at Archie’s discretion.
23. Jury Trial Waiver
Both you and Archie waive the right to a jury trial.
24. Governing Law
These Terms are governed by Delaware law.
25. Changes to Terms
Archie may update these Terms periodically. Continued use constitutes acceptance of updated Terms.
26. Entire Agreement
Archie may assign these Terms without restriction. Users may not assign without prior written consent.
27. Severability
If any provision is invalid, the remainder remains in effect.
